    That's right.

"Details of the negotiations have not been disclosed but Akbaruddin told Reuters that India and Italy had an agreement under which convicted prisoners could serve jail time in their home countries."

Update - We risked getting isolated internationally, says Italy PM

But economic interests didn’t influence decision to send back marines, Premier tells Parliament.

Outlining the reasons for sending back to India the two Italian marines accused of killing two fishermen off the Kerala coast, the outgoing Prime Minister, Mario Monti, said Rome faced a serious risk of being isolated internationally and could have opened a crisis of “serious proportions” with New Delhi.

More to do with the business interests of members in the EU, including Italy... And making false promises to a nation's supreme court to get something done is extremely unethical. No nation can accept such behavior.

Your theory of Business lobbying may be true too. Just came through a picture where Mr. Mancini himself inaugurated the Fiat Service, RDC in Chennai.

    Update-

A team of NIA sleuths is likely to visit Italy to question four Italian marines, who were witness to the killing of two fishermen off Kerala coast in 2012, after their refusal to come to India for deposition before investigators.

Notwithstanding New Delhi's consistent request to send the witnesses, Rome has made it clear that the four will not come to India to appear before investigators in connection with the case in which two Italian marines are accused.

    Italy warns India

Italy on Monday warned it would “react” to India’s “unacceptable” move to invoke a severe anti-piracy law against two of its marines facing trial there since 2012 over the killings of two Indian fishermen.

“The charge sought by Indian authorities is unacceptable,” Prime Minister Enrico Letta said in a message on his Twitter handle. “Italy and the European Union will react.”

If Italy is going to decide everything under the sun including under which section of the law the Italian marines should be charged with, I really see no reason why they shouldn't be tried in Italy.

I believe this was mistake but it does not take away the loss the families have suffered. Both countries could and should have handled these issues better, EU threatens then India will retaliate where will all this stop??

Businesses take precedence over politics, seems to be the norm of these times. Especially business in politics. Had it been Indians who would have shot Italians one wonders if they would have shown even this bit of leniency. We are left to asked them instead what charges should their marines be charges with apart from accidental manslaughter.
