3-9-2012ToTejaswi Motors, Sub:-Grievance regarding Refund of booking amount Sir, I along with my father happened to visit your showroom on 1[SUP]st[/SUP] September at around 3.00PM for test driving Fiat Punto. We met sri Rajesh sales assistant who explained us with regard to features of Punto, price of Punto dynamic and emotion version,My father took test drive of Punto and came back to the showroom. I noticed that Linea T-Jet was on offer for Rs.8,50,000 and asked sri Rajesh if it was available and could I have a test drive,he showed me the car in cellar, which was test drive vehicle, I asked him about fresh car ,he said it was not available in the show room, we went back . Later we sat in the lobby discussing about price of Punto, Mr.Rajesh told us about the price, gave us a copy of price list of Punto and wrote the details of discount available at the back of the list,he also gave us the broucher of Fiat Punto. I also saw Bosa Nova White Linea Emotion on display, sat in the car and asked Mr Rajesh about features. He explained a bit about it and told us that the model on display is of year 2011 and that its battery is dead and that he would sell it at Rs.9,80, 000. I then took a test drive of Linea 2012 along with my father and Mr. Rajesh accompanied us. . on coming back to the show room I had a closer look at linea on display, I expressed my apprehension that the vehicle is lying idle for one year and that there is rust on the discs of front wheels, Mr.Rajesh allayed our fears and said that it is normal and nothing to worry about, also he said we can inspect the body at workshop and that he would explain everything on moday, he repeatedly told us that we can trust him and that we need not buy even after checking the vehicle thoroughly after pre delivery inspection some time next week, if we are not convinced. Mr. Rajesh also convinced us that all the interiors would be cleaned, new battery will be put in place and also oil would be changed, he said we are giving 4 years warranty and that we need not worry at all, he even said that tyres would be replaced if we find any problem with them after use,as it is covered under warranty for one year. Mr.Rajesh repeatedly said he would explain everything on Monday evening and that we would not be at loss in making the purchase, with regard to Ground clearance also I was apprehensive as now it is 185mm whereas Ground clearance is 170mm in the 2011 model, he said one would not face problem in city but only in rural areas and when vehicle is rashly driven,he also compared with vehicles of other models. Mr. Rajesh said only one piece is left and that other 2 Lineas of 2011 have been sold recently and that he would remove this linea from display if we paid Rs25,000 and that he would send it to work shop on Monday and also he would clarify all our doubts on Monday. I said I did not have cash and that I would have to go home,my father sat in the lobby and I went away to get cash to book the car,I was asked to get address proof and identity proof. I came back and sat down at the table and expressed many doubts regarding as to why the car was not sold how many miles has it run as there was no display on the odometer, battery of the car being dead, he said he would explain it on Monday. he said I could trust him and that there is nothing fishy in the deal and that Fiat would never deceive its customers, and that this is the first exclusive show room in India .With regard to price he said he could offer the car for maximum of Rs 9, 60,000 and that it was his last offer and no reduction is possible. Me and my father in bonafide belief and trust paid the money for which receipt was given and also I was made to sign a commitment form which had many blanks in it and a clause that I was bound by terms and conditions of sale, I was not told about terms and conditions of sale, also no terms and conditions had been written on the form either. I was still not that convinced and spoke with my father separately; we nevertheless went home with lot of doubts. On reaching home I went through the internet for information on Fiat Linea features of 2011 and 2012 on coming to know that the emotion model of 2011 was 2012 dynamic model and that this year emotion is new model. I also checked up the prices of linea 2012 model and was taken aback as the price was for dynamic Linea with regular shade at Rs.10, 68,699. I also came to know that there would be standard offer of free insurance, RSA, extended warranty etc. I immediately called up Mr.Rajesh he said he would clarify all my doubts on Monday and that I need not worry. I was not convince at all I made calculations and was surprised that I would get 2012 dynamic version of linea at 10,20,000 and odd rupees, then why should I go for 2011 version with less ground clearance and old one. I made up my mind and on 2[SUP]nd[/SUP] September that is Sunday immediately called mr.Rajesh and said the deal would not go through and that I would send my father for collecting the booking amount on Monday and that he could speak to him. I was then warned for the first time that I would loose RS 10,000 booking amount, I said I would see about that on Monday. I am pained to write this lengthy letter as you have pulled a fast one upon me, I being first time consumer, I am saddened at the state of affairs your esteemed dealership. Firstly I was not given the price list of Linea so that I could be aware of prices of the present 2012 model, I was not given the prices of 2011 nor the feature broucher of 2011 linea so as to make any informed choice. I was repeatedly assured of fair deal by Mr.Rajesh Secondly Mr.Rajesh has not informed me that the present Linea dynamic 2012 is emotion of 2011, I was repeatedly assured of clarification on Monday. But why should your employee ask me to pay booking amount and take commitment from me without clarifying. I have naturally in good faith trusted your dealership and paid the money. thirdly Mr.Rajesh at no point of time warned me that I would lose Rs.10000/- in case I cancelled booking amount, even while signing the commitment form I was not warned, nor such clause reflected in the form. Fourthly why was Rs.25000 demanded of me when the booking amount is only Rs.10000. I have lost faith and confidence in your dealership and therefore kindly request you to refund the entire Rs.25000 without any deduction at the earliest. I donot want to escalate the matter any further I am not interested in making any publicity stunt, I wish to believe that my case is one off and not regular occurrence in your showroom and that you honestly deal in your affairs and that not all of your employees are like Mr.Rajesh. I would not like to compare you with other dealers of Fiat in city also, but it is unfair on your part to put Rs.10000 as booking cancellation charges when other is charging only Rs.1000. I assure you that in case you donot take remedial action in this regard, I would approach every forum to redress my grievance in this regard, the consequences for which will be born by you and I would not be responsible under any account. Hoping for early and concrete resolution at the earliest. Yours sincerely

My apologies moreau. You post opens thus - "well i happened to visit the so called exclusive indias first showroom for FIAT CARS. it was a bitter experience"

I do not see any mention of the Dealership name here. Your grouse is against them and not FIAT, right? In that case, I believe the above opening of your post would be quite mis-leading to a casual reader. This is a public forum, so I believe it is the responsibility of the poster to communicate correctly.

IMO, what I termed as your short comings are:

1. You decided to book a 2011 model, without any research before-hand
2. You signed a document agreeing to be bound by terms and conditions that you were not aware of
3. It is normal that some amount will be deducted in case of cancellation. Either you were not aware of this, or you did not confirm with the dealer
4. In essence, Sir, you did not do your homework, before making a 10L purchase decision.

As I already said, I have nothing personal against you and would possibly not have even responded to your post, had to mentioned the name of the dealer. Please step back a minute and think - Another potential buyer would do the same kind of research you did, will come across this forum and your post. What is the message he gets?

"FIAT does dubious deals"

He will then proceed to buy another aluminium foil CSO, as he did not bother to read on and understand that you still went ahead and bought a Punto, right?

i am not running publicity business for cars sir i am just sharing my experience,as far as you say my short comings i believe that it was basically lack of information. and why should one always proceed with suspicion,if that is your view, why would anybody buy a fiat car at all.

Dear Rudresh,

Honestly. This is an old quotation and I request you not to go by this quotation completely.

Please contact Nirosha. I have already informed her about you couple of days back, when I was there to help a friend of fellow TFIan for booking a 90HP sports. She said that she will look into the matter when you approach her. Please PM me your contact number, I might be able to explain you more clearly.

In whose name would you be registering the vehicle? The life tax is 12% if you donot have any other vehicle registered in your name. The same would be 14% if you already have any another vehicle (2/4 wheeler) registered in your name. This amount can be saved if you transfer the existing vehicle to your parent's or spouse's name. The transfer would cost you some where around 700 Rs. if you approach directly or 1200 Rs. if you get it done through an RTA agent from Tejaswi. TR charges is for the Temporary Registration. They will also charge you Rs.3000 in addition to this as permanent registration charges (for the agent). You better get it done by yourself.

Handling charges have to be paid, but I am not sure about the amount. Rs. 4500/- seems to be on the higher side. Its strange that there is no mention about the Absolute pack in the quotation. Its their duty to inform any prospective customer about the on-going discounts and offers. Also they didnot mention about any corporate discount. If you plan to exchange your car, you can also get an exchange bonus. Your signature mentions that you own a Ford Ikon. There is a small tweak that we can do even if you are not planning to exchange it. I will tell you the details over the phone.

Good Luck!!!

this is in response to exchange bonus which a person is entitled to even without exchanging his old car mentioned by kiran. well i was also offered exchange bonus if i give a xerox copy of registration of my old car, without exchanging the car,the dealer
offerd me 15000 exchange bonus on linea.i didnot know what is the catch untill i went to another dealer who said they would forward the xerox copy of registration of my old car, to FIAT who would on the bonafide impression that the customer has genuinely exchange give the dealer a commission. when i told the dealer of the above offer from other dealer,he said that such unethical practice would land both the dealer and the customer in a soup if FIAT finds out that really the customer has not exchanged his car for a brand new FIAT car.
My best advice would be not to get into shady deals with dealers just to save some money at the cost of the parent company. This being a FIAT car fan forum let us pay the price which the manufacturer is offering the car after all discounts. good things always have a price, let us not play cheap with the FIAT company, after all it produces a quality product, and honesty always begets honesty.

I was not aware that the dealer would get a comission out of the exchange bonus offer. I was under an impression that they are trying to help us out by getting some more discount on the current price. Thanks for the information moreau.

i have lot to say about the way dealers and their employees are dealing with customers, especially the bills, the calculation of discount, preparation of invoices etc,etc the list goes on unending. the way forms of RTA are prepared haphazardly,i have a strong hunch of unethical practises between RTA and the dealers, brokers at RTA etc.I am having a thorough first hand experience at the hand of dealers, employees, yet to visit the RTA.
i am quite pressed for time,i received my punto on 26-9-2012 home delivered, papers are in horrible condition ie.details of car in FORM 20 and others,i am investigating,i hope to resolve matters with cool head,i am losing patience.i would strongly recommend perhaps it be made compulsory for the manufacturer to sell and service cars directly with no dealers in between. there is lot of fishy business going on, to be precise showing discount in invoice but collecting money and saying we will give receipt seperately, the dealer says free insurance worth 25000 but the insurance company gives certificate cover for 13000 only. this is just the begning,i have gone through a lot,it has become a nightmare to purchase a vehicle.
i am no rich mans spoilt brat i have earned every penny through sheer perseverance, lot of patience, getting short changed is disgusting,i wont let things pass so easily.i being self employed get lot of benefit in terms of tax concessions,i will recover cost of vehicle in flat 3yrs with insurance, fuel, maintenance, driver salsry as deductible expenditure. The dealers and their employees are playing havoc with customers, just because one doesnot know about nuiances of financial transactions, their tax implication etc. i will keep posting for generating awareness among members about the dealership practices.
